The following Terms apply to all purchases of Tickets and all Entries submitted to any Competition on the Promoter’s Website.
When joining Big Tech Rush, Entrants will be required to confirm on the Website that they have read and accepted these Terms and agreed to be bound by them.
The Promoter
- All Competitions are operated by the Promoter, The Big Tech Rush, a trading name of Leevoke Ltd (company number 14471622), whose registered office is at 13 Foundry Lane, Copford, Colchester, Essex, CO6 1BH. The Promoter is the official sponsor of each Competition unless specified otherwise.
How to Enter
- By submitting an Entry, Entrants agree to be bound by these Terms. If you do not agree to be bound, do not purchase Tickets and do not submit an Entry.
- To enter a Competition, a Visitor must: a. become a Registered User by completing all required details on the Membership Form on the Website, providing a valid e-mail address and contact telephone number; and b. answer the Competition Question; and c. either pay the applicable Entry Fee to purchase the desired number of Tickets, or submit a free Postal Entry in accordance with terms 7 to 10 below.
- Purchases of Tickets shall be processed by the Promoter’s payment provider, Cashflows (Cashflows Europe Limited). All payments are subject to the payment provider’s own terms and conditions, which are available to view on their website.
- Purchasers of Tickets will be asked to provide their contact details, including an e-mail address and telephone number. This information will be processed in accordance with these Terms and the Promoter’s Privacy Policy, available on the Website. The Promoter’s payment provider will require the purchaser’s card payment details and may require their cardholder name and/or postcode. Once the purchase order for the Tickets is submitted, the Registered User’s card payment will be electronically processed and the Promoter will not retain any record of the Registered User’s card details.
- The Competition Question must be answered before an Entry is submitted, whether the Entry is paid or made via free Postal Entry. The Competition Question applies equally to all Entrants and does not affect the availability of the free Postal Entry route.
Free Postal Entry
- Entry to any Competition is available free of charge by Postal Entry. The Postal Entry route is open to every Competition and is offered on equal terms to paid entry. No purchase is necessary to enter or win.
- Entrants entering via Postal Entry must first become a Registered User, and must then post, on a postcard or letter, the following information, printed in legible English: a. their full name; b. the e-mail address and contact telephone number registered to their Account; c. the title of the Competition they wish to enter; and d. their answer to the Competition Question. Postal Entries must be sent to: Big Tech Rush, 105 Douglass Tower, 9 Goodluck Hope Walk, London E14 0XD.
- Postal Entries: a. must be sent by first- or second-class pre-paid post, with correct and sufficient postage paid (entries with insufficient postage will be invalid); b. must be received by the Promoter at the address in term 8 before the earlier of the Draw Date of the relevant Competition or the point at which the Competition sells out; c. must be made on a postcard or letter only — attempted Postal Entries received on anything else will not be accepted; d. count as a single Entry (one Ticket-equivalent) each. Where multiple entries are received on a single postcard or within a single envelope, only one Entry will be entered into the relevant Competition; e. will not be processed if the Entrant’s Account cannot be identified from the details provided; and f. cannot be made by personal or hand delivery, which will not be accepted.
- Each Entrant may submit Postal Entries up to the maximum number of Entries per Competition set out in term 14, counted together with any paid Entries.
Eligibility
- Competitions are open for entry only to private individuals (i.e. not a limited company, partnership or limited liability partnership) aged 18 (eighteen) or over and resident in Great Britain (England, Scotland or Wales), excluding the Promoter and its staff and any person professionally connected with the running of a Competition.
- Only Registered Users are eligible to enter any Competition. A Registered User may hold only one Account.
- In entering a Competition, all Entrants confirm that they are eligible to do so and eligible to claim any Prize awarded. The Promoter may require any Entrant, including any Winner, to provide evidence that they are and were eligible to enter a particular Competition. By entering, Entrants warrant that all information they submit is accurate, true, current and complete.
Tickets, Entries and Caps
- Each individual Entrant may submit a maximum of 1,000 (one thousand) Entries in total per Competition, counting paid and free Postal Entries together. The Promoter will not accept Entries beyond this limit.
- Each Competition has a maximum total number of Tickets available, which is stated on the relevant Competition page on the Website. Once this cap is reached, no further Entries (paid or postal) will be accepted for that Competition.
- All Entry Fees paid to the Promoter, and all Entries to any one Competition, are final. Refunds shall not be given at any time except as set out in terms 32 and 44. Consumer “cooling-off” rights do not apply to the purchase of Tickets.
- The Promoter will not accept and will not refund Entries (whether paid or by Postal Entry) that are: automatically generated by computer; completed by or on behalf of a third party; paid for using a card belonging to someone other than the Entrant; altered, reconstructed, forged or tampered with; incomplete; or otherwise not made in accordance with these Terms. Joint submissions and entries on behalf of another individual are not accepted.
- Only Entries made in accordance with these Terms will be entitled to participate in a Competition and be eligible to win a Prize.
The Draw
- The Winner of each Competition will be determined and awarded the relevant Prize specified on the Website in accordance with these Terms. Each Competition has one Winner unless the relevant Competition page states otherwise.
- The Draw to determine the Winner will be conducted live on camera and broadcast or recorded for the Promoter’s channels. The Winner is selected at random using Google’s random number generator, displayed on screen during the Draw, applied to the full range of valid Entries.
- The Draw Date is the earlier of (a) the published closing date for the Competition, or (b) the date on which the Competition’s Ticket cap sells out. Where a Competition sells out before its published closing date, the Promoter may bring the Draw forward.
- The Draw will take place on the Draw Date regardless of the number of Tickets sold. The Promoter does not require a Competition to sell out, or to reach any minimum level of sales, for the Draw to proceed. The Promoter will not cancel a Competition, or withhold or postpone a Draw, on the grounds of low sales.
- The Promoter will not extend the closing date for any Competition except where this is brought about by circumstances outside the Promoter’s reasonable control (for example, a server failure).
- The Promoter shall preserve the random nature of the Draw. In the event that any mechanical or technical defect occurs in relation to the Draw (for example, an incomplete or invalid number being produced), the Draw will be cancelled and re-run once the defect has been remedied, or, failing that, conducted using an equivalent random method. The result of the Draw is final and the Promoter shall not enter into correspondence about it.
Prizes
- The Promoter does not offer a cash alternative to any Prize. A cash alternative will be available only where it is expressly stated in the description of a specific Prize.
- The Promoter reserves the right to substitute any Prize with a Prize of equal or greater value if, for reasons outside the Promoter’s control, the advertised Prize becomes unavailable.
- Before any Prize is released, the Winner will be required to pass identity and address verification (KYC), forwarding to the Promoter valid photographic identification (such as a passport or driving licence) and a recent document confirming their address (such as a utility bill). The Promoter may refuse to deliver the Prize if the requested verification is not satisfactorily completed, or where the Promoter reasonably believes there may be a lawful impediment to awarding the Prize.
- The Promoter will make all reasonable efforts to deliver each Prize within a reasonable time but does not guarantee receipt within any particular period.
- If a Winner cannot be contacted by the Promoter within 30 (thirty) days of being notified of their status (using the contact details on their Account), the Promoter shall be entitled to forfeit that Winner’s claim to the Prize and re-draw the Competition to select an alternative Winner, who shall likewise be subject to the 30-day contact requirement. Once a Winner has lost their claim to a Prize, they will have no further claim against the Promoter.
- The Promoter is entitled to refuse delivery of a Prize to a P.O. box or any other location that may be used to conceal the identity of a Winner. The Promoter accepts no liability for non-receipt of a Prize caused by incorrect or incomplete delivery details provided by the Winner.
- The Promoter gives no warranty as to the value, condition or history of any Prize, save in respect of the Entrant’s statutory rights. If the Promoter delivers a Prize of greater value than that advertised in error, the Winner must, on request, return the excess value.
- The Promoter reserves the right to remove a Competition from the Website at any time. In the rare event this occurs, the Promoter will refund the Entry Fee of each relevant paid Entry, and an imputed Entry Fee (equal to the value of a Ticket in that Competition) for each relevant Postal Entry, to the affected Registered Users as Site Credit.
Instant Win Competitions
- The Promoter may from time to time run Instant Win Competitions, in which a number of instant-win prizes are available within a Competition. Where a Ticket number allocated to an Entrant corresponds to a ticket number listed against an instant-win prize in the Competition description, the relevant instant-win prize is awarded to that Entrant. Instant-win prizes are awarded only by direct correspondence between the Entrant’s allocated Ticket number and the listed prize number, and for no other reason. In Instant Win Competitions, Ticket numbers are randomly allocated and the ticket selector is disabled.
Flash Competitions
- The Promoter may from time to time run Flash Competitions, being Competitions with a duration of 48 hours or less. Flash Competitions are entered in the same way as other Competitions (including the free Postal Entry route), and all of these Terms apply to them save where the relevant Competition page states otherwise.
Site Credit
- Site Credit is a store of credit applied to a Registered User’s Account that can be used to reduce the checkout balance on future Ticket purchases. Site Credit has no cash value, cannot be withdrawn or exchanged for cash, and is non-transferable.
- Site Credit expires 12 (twelve) months after the date it is issued, after which any unused balance will be voided without compensation. The Promoter will make the issue date and expiry of Site Credit visible to the Registered User on their Account.
- The Promoter may from time to time run promotions under which Registered Users receive benefits such as Site Credit, additional Tickets or discounts. Unless otherwise stated, such benefits are limited to one claim per individual, and the Promoter reserves the right to decline or void any benefit it reasonably believes is being claimed beyond its intended limit or in a manner contrary to the spirit of the promotion.
Referrals
- The Promoter may operate a Referral scheme under which a Registered User who refers another person to register and enter may receive a reward (such as Site Credit or additional Tickets), subject to the terms of the specific scheme published on the Website at the time.
- The Promoter reserves the right to void any Referral, and any benefit accruing under it to either participating individual, for any reason, including where the Promoter reasonably believes that an individual is in effect referring themselves across more than one Account, that Accounts are Linked Accounts, or that the scheme is otherwise being abused. Where benefits have already been claimed in such circumstances, the Promoter is entitled to reclaim them or their equivalent value, with no refund given.
Fraud, Multiple Accounts and Account Suspension
- An Entry shall be declared void, without refund, if the Entrant engages in, or the Promoter at its sole discretion reasonably believes the Entrant is engaging in: any form of fraud, fraudulent misrepresentation or fraudulent concealment; hacking or interference with the proper functioning of the Website; or unauthorised use of, or use of information from, the code of the Website to gain an advantage over other Entrants.
- Registered Users may not create or operate more than one Account, whether under fake names or otherwise. Linked Accounts are prohibited. Where the Promoter, in its sole and reasonable estimation, determines that Entries, Site Credit, promotional benefits or Referral rewards are being made or claimed by the same individual from more than one Account, or by Linked Accounts, all such Entries and benefits will be voided with no refund, no Prize, Site Credit or other benefit will be paid out, and the Promoter is entitled to reclaim any Prize, Site Credit or benefit (or its equivalent value) already provided to any of the Accounts in question.
- The Promoter accepts no liability for, and is entitled to treat as void, any Entry affected by a payment chargeback, reversal or dispute. Where an Entrant initiates a chargeback or payment dispute, the Promoter may suspend the relevant Account, void affected Entries, and recover any Prize or benefit awarded, in addition to any other remedy available to it.
- The Promoter reserves the right to close or suspend a Registered User’s Account, and to prevent the individual from participating in future Competitions, at any time where: the Registered User has made abusive, misleading or factually incorrect statements about the Promoter (including on social media or review sites); the Promoter reasonably considers the Registered User has used the Website fraudulently, unlawfully, unfairly or for the benefit of a third party, or has deliberately cheated; the Promoter is requested to do so by the police, a regulatory authority or a court; the Promoter reasonably suspects the Registered User is under 18; or the Account is dormant. Where an Account is closed or suspended for any such reason, the Promoter may at its discretion disqualify Entries already made to Competitions for which the Draw has not yet taken place.
Announcement of Winners and Publicity
- Where requested by the Promoter, each Winner is required to provide, and to be captured in, photographs and video, and consents to the use of their first name, town or county of residence, image, and any photographs or video taken of them (including footage of the live Draw) being published on the Website and across the Promoter’s marketing and social media channels and any other medium, in connection with the Competition and the promotion of the Promoter’s business.
- A Winner may refuse consent to such use at any time up to the point of publication; any such refusal must be received by the Promoter in writing. Where a Winner of a Prize that was offered free of charge refuses to participate in reasonable publicity activity, the Promoter reserves the right, at its sole discretion, to withdraw the Prize and re-draw the Competition. All content captured of a Winner, whether by the Promoter, its agents or the Winner themselves and provided to the Promoter, is deemed to be the property of the Promoter.
Brand Non-Association
- The Promoter’s Competitions and promotions are in no way sponsored, endorsed, administered by, or associated with Apple Inc., Google LLC, Sony Group Corporation, Dyson Ltd, or any other manufacturer or brand whose products may feature as a Prize, nor with any of their respective subsidiaries or affiliates. No such brand has any involvement in the organisation, conduct or promotion of any Competition, nor is responsible for providing any Prize or customer support. Entrants acknowledge that any information provided in connection with a Competition is provided to the Promoter and not to any such brand.
Data Protection
- The Promoter will store and process Entrants’ personal information in accordance with these Terms and the Promoter’s Privacy Policy, available on the Website. Personal information will be used to administer the Website and Competitions, to notify and verify Winners, and (subject to term 44) to publish and promote results. All Entrants are solely responsible for providing the Promoter with accurate and current contact details, and the Promoter will not be liable for any failure to make contact with an Entrant due to errors or omissions in the details provided.
Limitation of Liability
- Insofar as permitted by law, the Promoter, its agents and distributors will not be liable to compensate any Entrant, or accept any liability, for any loss, damage, personal injury or death arising out of submitting an Entry or in relation to the use or enjoyment of a Prize, except where death or personal injury is caused by the Promoter’s negligence or fraud (or that of its agents, distributors or employees). The Entrant’s statutory rights are not affected.
- The liability of the Promoter to each Entrant is limited to the aggregate value of the Entry Fees paid by that Entrant.
- The Promoter accepts no liability for errors or omissions in the description, value or specification of any Prize, or any other part of the Website. It is the responsibility of each Entrant to satisfy themselves as to the accuracy of any such details.
- The Promoter accepts no liability for errors or omissions caused by human error or technical faults within its infrastructure, including (for example) the system wrongly promising or paying out a benefit, drawing a Competition twice, or an Instant Win Competition having its ticket selector wrongly enabled. In such situations no benefit shall be payable and, subject to a full refund (as Site Credit, or to the original payment method where the Entrant prefers), the Promoter shall have no further liability. Confirmation e-mails and other communications do not constitute acceptance of any transaction.
- The Promoter accepts no responsibility for Entries (including Postal Entries) that are lost, mislaid, damaged or delayed in transit or in receipt, regardless of cause, including postal failure, equipment or network failure, or natural events.
General
- The Promoter reserves the right to suspend or cancel any Competition at any time, before or after Entries have been received, where a human or technical error has resulted in participants being awarded Prizes unfairly or being disadvantaged, so that every participant has the same chance of winning per Ticket. Where a Competition is cancelled due to the Promoter’s actions, the Promoter will return each relevant Entry Fee, and the imputed Entry Fee for each Postal Entry, to the affected Entrants as Site Credit, after which the Promoter shall have no further liability.
- Without prejudice to term 53, the Promoter reserves the right to cancel any Competition in the event that an order is made or resolution passed for the winding up of the Promoter, an administrator is appointed, or analogous insolvency circumstances arise.
- The Promoter reserves the right to make reasonable amendments to these Terms at any time, with effect upon publishing the amended Terms on the Website. Such amendments shall not prejudice any Entries received before the change.
- These Terms shall not create or be construed as creating any contract, joint venture or other agreement between any Entrant and the Promoter beyond the operation of the Competitions.
- All Competitions promoted by the Promoter, their administration and all associated activities, shall be governed by the laws of England and Wales, and all parties submit to the exclusive jurisdiction of the courts of England and Wales.
Definitions
Throughout these Terms, the capitalised terms below have the following meanings. Plural forms have the same meaning as the singular.
Account — a Registered User’s Big Tech Rush account.
Closing Date — the published date on which a Competition closes.
Competition — any prize draw operated by the Promoter on the Website to which these Terms apply, in which Entrants submit one or more Entries for a chance to win a Prize.
Competition Question — the question that an Entrant must answer in order to submit an Entry.
Draw — the random selection of a winning Entry, conducted on the Draw Date to determine the Winner.
Draw Date — the date on which the Draw takes place, being the earlier of the Closing Date or the point at which the Competition sells out.
Entrant — any private individual who submits an Entry in accordance with these Terms.
Entry (and Entries) — an entry made in accordance with these Terms, through the Website or by free Postal Entry, in order to gain an opportunity to win a Prize.
Entry Fee — the fee payable to submit a paid Entry. The fee is stated clearly for each Competition and may vary between Competitions.
Flash Competition — a Competition with a duration of 48 hours or less.
Instant Win Competition — a Competition featuring instant-win prizes awarded where an Entrant’s randomly allocated Ticket number matches a ticket number listed against an instant-win prize in the Competition description.
Linked Accounts — any two or more Accounts linked by any shared detail, including name, contact details, payment details or activity patterns.
Membership Form — the form a Visitor completes on the Website to become a Registered User.
Postal Entry — a validly composed and posted postcard or letter, made in accordance with these Terms, that is received by the Promoter.
Prize — the good, item, promise or service specified in a Competition that a Winner may receive.
Prize Value — the stated value of a Prize.
Promoter — The Big Tech Rush, a trading name of Leevoke Ltd, company number 14471622, registered office 13 Foundry Lane, Copford, Colchester, Essex, CO6 1BH.
Referral — where a Registered User refers another person to register and enter on the Website.
Registered User — a Visitor who has completed the Membership Form.
Site Credit — a store of credit applied to a Registered User’s Account that can be used to reduce the checkout balance, as described in terms 35 to 37.
Tickets — the virtual tickets that Registered Users acquire (by paid Entry or free Postal Entry) in order to enter a Competition.
Visitor — any unique natural-person visitor to the Website.
Website — the Promoter’s website and all sub-domains attached to it.
Winner — the Entrant selected by the Draw on the Draw Date in accordance with these Terms.
